Avoid Storing Construction Materials in County Rights-of-Way

Date:                June 20, 2024

To:                   Construction Industry

From:              Charlotte County Community Development

Subject:           Avoid Storing Construction Materials in County Rights-of-Way

Charlotte County Community Development reminds contractors of the regulations concerning the storage and delivery of construction materials in county rights-of-way, especially during the rainy season.

According to Sections 3307 and 3308 of the Florida Building Code (Building) and Sections 3-5-94 and 3-5-95 of the Charlotte County Code, the storage of construction materials in drainage swales and county rights-of-way is strictly prohibited. This prohibition is enforced by the Right of Way Division of Public Works under County Ordinance 2021-009, to ensure the safety of vehicular and pedestrian traffic and to prevent the obstruction of water flow, which can cause flooding of adjacent properties and roadways.

Contractors are urged to find alternative storage solutions that do not compromise the county’s drainage systems.
